General Terms and Conditions
The customer acknowledges having read, at the time of placing the order, the conditions of sale set out below and declares to accept them.
1. PRODUCTS – PRICES
1.1. Products
Only Products appearing on the Site on the day of consultation by the Customer are offered for sale. Product offers are limited to mainland France and member countries of the European Union. Product offers and prices are valid, while stocks last, as long as they are visible on the site.
1.2. Price
The prices of our products are indicated in euros, all taxes included and excluding shipping costs, knowing that shipping costs are added to the amount of the order. We reserve the right to modify our prices at any time but we undertake to apply the current prices which will have been indicated to you at the time of your order. In the event of an order to a country other than France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and amounts do not fall within our control. They will be your responsibility and are your sole responsibility both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.
2. ORDER – PAYMENT
2.1 Order validation
Validation of the basket confirmation constitutes an electronic signature. This signature has the same value between the Parties as a handwritten signature and constitutes proof of the entirety of the order and the payability of the sums due in execution of said order. As soon as he has validated his order, the Customer becomes a Buyer. Notwithstanding the application of article R624-3 of the penal code, the Customer will pay for his order by bank card (credit card, Visa, Eurocard/Mastercard). If the Customer wishes to pay for his order by credit card, he must provide his bank card number. Depending on the type of the latter, its expiry date as well as the cryptogram number.
2.2 Contract
When you place an order you will receive an email acknowledging receipt of your order. This email is only an acknowledgment of receipt and does not in any way constitute acceptance of your order. The contract entered into will be formed at the time of validation of the order and its payment. Only products listed in the confirmation email sent at time of shipment will be included in the contract.
2.3 Payment
Upon receipt of your order, we will pre-authorize your payment card to verify that there are sufficient funds to cover the transaction. Products will not be shipped until this pre-authorization process has been completed. Your payment card will be charged once the order is accepted.
3. DELIVERY
Modress will make every effort to ensure that the order is delivered within 48 hours to 72 hours after your order is shipped. Orders placed on Modress.com are processed and sent within 24 hours, Monday to Friday, excluding public holidays, upon receipt of payment. All orders placed on weekends or public holidays will be processed the following business day.
It is specified that orders recorded on the Modress.com website on Friday afternoon, Saturday or Sunday are processed the following Monday. Orders placed on the website www.Modress.com on a public holiday other than Friday, Saturday and Sunday are also processed the following business day. The Products ordered by the Buyer are delivered in mainland France and all countries of the European Union, to the address indicated by the Buyer on the page of the final validation of his order, accompanied by a voucher. delivery. The Buyer has the option of having the Products delivered to an address other than his own. Modress may exempt itself from all or part of its liability concerning delivery inconveniences by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer or to the unforeseeable and insurmountable fact of a third party to the contract, or in a case of force majeure.
Items are delivered while stocks last. In the event of unavailability of the ordered product, Modress will honor the order for other products, the Customer will be invoiced only for the products actually shipped.
4. RIGHT OF WITHDRAWAL
The Buyer has a period of 30 working days from the date of receipt to return, at his own expense or by Mondial Relay (€4 will be deducted from the order for a return with Mondial Relay. If the aforementioned conditions are met, Modress will reimburse the buyer for the full amount of the products, within thirty days from receipt by Modress of the products.
5. MEDIATOR

6. APPLICABLE LAW
These general conditions of sale and the contractual relations between Modress and the Buyer are subject to French law. In the event of a dispute, exclusive jurisdiction is assigned to the competent French courts. Modress, however, undertakes to seek an amicable solution before any legal action.
